Effective Resolutions Of Legal Matters Through Mediation

Legal matters should be handled by the people who know the issue at hand and have a vested interest in seeing things resolved quickly and amicably. Unfortunately, when left to a judge’s discretion, legal matters don’t always get resolved that way. In such cases, mediation may be a better way forward.

At the Merrell Law Firm, LLC, we have two attorneys who have undergone extensive training as mediators and can take appointed cases, or they may be hired by the parties or their attorneys to assist in settlement of legal matters or disputes. Our nearly 39 combined years of experience across a range of practice areas allows our team to effectively handle any matter or issue, helping our clients avoid the time and costs associated with going to court.

What Is Mediation?

Mediation is a form of alternative dispute resolution that allows both sides to come together and discuss their issues and positions with a third party, called a mediator. The mediator is a neutral party representing neither side. They are there to assist the parties in reaching a mutual agreement.

In mediation, the parties are in control of the final outcome, rather than a judge. It is beneficial because while a judge might be bound by certain legal constraints, the parties are not, allowing them greater flexibility in working toward a solution. In mediation, the parties both give and take — neither side gets everything they want — but typically a viable resolution is reached. Also, if mediation does not work, the parties can still take their complaint to the courts.

We Can Be Your Guides Through Any Issue

Mediation can be incredibly effective to resolving a range of family law issues, including:

Mediation can be beneficial in other areas of law. We also offer mediation services in civil litigation matters — including contract disputes, insurance matters and more — as well as in business litigation matters — including breach of contract issues, commercial dissolution proceedings and more.

Whether we’re serving as a neutral mediator between parties or representing you and your best interests, you can rest assured that you will be working with attorneys who are committed to making sure negotiations run smoothly and efficiently in order to reach an amicable resolution. Our knowledge and guidance become invaluable resources for clients in the Hoover area as well as all over Jefferson, Shelby, St. Clair and Tuscaloosa counties in Alabama.

Private Judging: Another Amicable Way To Resolve Your Divorce Issues

According to the American Bar Association, private judging is “a process where the disputing parties agree to retain a neutral person as a private judge. The private judge, who is often a former judge with expertise in the area of the dispute, hears the case and makes a decision in a manner similar to a judge.”

As with mediation, working with a private judge can help men, women and children avoid the bitterness and frustration that often accompanies a traditional divorce. A private judge can help pave the way to an agreement that settles issues in a way that both parties can live with so they can move forward.

At the Merrell Law Firm, LLC, we offer the services of Julie A. Palmer, a private judge with nearly 30 years of legal experience. She has earned the respect of her colleagues in the legal community and brings her tremendous record of accomplishment as a private judge and mediator to our practice.
